Rules of the "AERO CHALLENGE" game

Article I: Organisation

BABOLAT VS, a public limited company with Board of Directors and a share capital of €1,275,000, recorded in the Lyon Trade and Companies Register as number B 552 131 401 and having its registered head offices at 93 rue André Bollier, 69007 Lyon, France, will be running a game called “AERO CHALLENGE ", from 00.00hrs (French time) on 1 February 2010 to 23.59hrs (French time) on 2 May 2010.

 

Article II: Participation

Participation in this free game, which carries no obligation to buy, is open to any individual with an Internet connection and a valid email address (save for staff and representatives of the organising company, its partners and sub contractors as well as their advisers and members of their families) residing in France, Italy, Spain, Great Britain, the United States of America, Germany or Austria, where local regulations are not in conflict with the rules set out below. Minors may play the game subject to the liability and with the consent of the statutory representative who can show that they hold parental responsibility for them.

Should a minor be drawn to win the trip to Paris, he or she must invariably be accompanied by an adult. Only one entry may be made per person (having the same name and address). Entry is on a strictly individual basis and the player may under no circumstances play on behalf of other entrants. Any entry form that is incomplete, illegible, sent after the closing date or in a format different from that provided for, shall be considered null and void.

 

Article III: Terms and conditions

To take part, it is only necessary to log on to the following Internet address: www.aerochallenge-babolat.com and complete the entry form.   It should be noted that only entries received on www.aerochallenge-babolat.com  will be considered.

Database used to draw the trip to Paris prize: the database used to draw this prize shall be that put together on the game site in real time.   Principle of the "Facebook Challenge" game: the game is free of charge and carries no obligation to buy. It is based on the principle of a network game accessible to all members of the Facebook community. To access it, you need only log on to it from the Aero Challenge official Website at www.aerochallenge-babolat.com. To access the game, you first need to have opened a Facebook account (at www.facebook.com).

Trip to Paris :
Lots will be drawn for the weekend in Paris by Maître Tronel, Bailiff, or one of his colleagues at the latest at 18.00 hrs (French time) on 5 May 2010.

Challenge Facebook :
As regards the Facebook Challenge linked to the Aero Challenge, every Monday at 00.00hrs (French time) throughout the period of the game, BABOLAT VS will draw lots to award prizes to three players in the Top 10 of the Facebook Challenge ranking published on the www.aerochallenge-babolat.com Website.

General rules applicable to both games:

BABALOT VS will inform the winners of the results by email and/or by telephone. If the winners have not replied within seventy-two (72) hours of being informed of their win, they will be disqualified and their prize will be lost as defined in Article VIII. Prizes may not be replaced by a cash payment or any other form of compensation and are non-transferrable. Nonetheless, in the event of force majeure, BABOLAT VS reserves the right to replace the prizes quoted with other prizes of equivalent value. For the purpose of sending out prizes, entrants choose as their place of residence that shown on the entry form. Winners give permission for checks to be carried out on their identity and place of residence (postal and/or Internet address). The provision by the winner of false information as to identity or place of residence shall invalidate the win and all aspects of his entry.

   

Article VI: Legal filing

These rules are deposited with SCP FRADIN TRONEL SASSARD et Associés (at the Offices of FRADIN TRONEL SASSARD and Associates), huissiers de justice Associés, (Associated Bailiffs), 1, quai Jules Courmont 69002 Lyon. The rules may be altered by the organiser at any time by means of an amendment which is in accordance with the stated terms and conditions and is published on line. The amendment shall be registered at the offices of the Bailiffs where the rules were deposited prior to publication. The amendment shall come into effect once it has gone on line and, with effect from the date when it comes into force, all entrants shall be deemed to have accepted it by virtue of the simple fact of taking part in the Game. Any Player who does not accept the amendment or amendments that have been made should cease to take part in the Game. A copy of the rules shall be sent free of charge to any person making a written request for one prior to the closure of the game. Requests should be sent by post to the following address:

Article VII: Disputes and liabilities

Participation in this game implies acceptance without reservation of the entirety of the rules. Where one or more provisions of these General Rules is declared null and void, the other clauses shall remain entirely in force and retain all their meaning. Any inaccurate or false statement and any fraud shall lead to the participant being disqualified. BABOLAT VS, in agreement with SCP FRADIN TRONEL SASSARD et Associés, Bailiffs, shall be the sole judge of any dispute relating to the game and its rules. No response shall be given to any written or telephone request regarding the interpretation or application of these rules, the mechanics or terms and conditions of the game or the list of winners. In the event of any challenge, only a registered letter with acknowledgement of receipt within one (1) month of the declaration of the result shall be deemed acceptable.

BABOLAT VS reserves the right, as circumstances may require and whilst abiding by the provisions of Article VI, to shorten, extend, modify or cancel this game. It shall not become liable as a result of so doing. BABOLAT VS may cancel or suspend all or part of the game if it appears that frauds of any kind have been perpetrated, in particular by computer, during participation in the game. Should this occur, BABALOT VS reserves the right not to award the prize to the fraudster and/or to bring a case against the perpetrator or perpetrators of the said fraud before the competent courts.

 

Article VIII: Awarding of prizes

All information about trips (transport, hotel) shall be sent to the winners by BABOLAT VS. An official representative of BABOLAT VS will meet the winners on their arrival.   All the prizes produced shall be sent to all winners after the game.

By virtue of accepting their prize, winners allow BABOLAT VS, for a maximum period of two (2) years, to use pictures of them, their surnames and forenames and their postal or Internet addresses in any publicity or promotional material linked to this game without such use giving rise to any form of compensation other than the prize awarded. BABOLAT VS may not be held liable for any delay, loss, damage, or illegibility of postmarks caused by the postal services and occurring when prizes are being delivered. Prizes which are unclaimed or are returned within 30 calendar days after their despatch shall be lost to the player and shall remain the property of BABOLAT VS. Winners shall give up the right to claim from the organising company any damages resulting from any harm caused by the acceptance and/or use of the prize.

 

Article IX: Agreement on Evidence

Except in the case of obvious errors, it is agreed that data emanating from BABOLAT VS game systems shall have evidential value in any dispute concerning the connection or processing of the said data on the game.

 

Article X: Jurisdiction

Participants shall be subject to the French regulations relating to games and competitions. Any dispute which cannot be settled amicably shall be a matter for the competent courts as designated in the French Code of Civil Procedure.

 

Article XII: Data Protection

Any personal data gathered in the context of this game shall be processed in accordance with the “Loi Informatique et Libertés” [French Data Protection Act] of 6 January 1978. Under Article 27 of the French Data Protection Act, all participants in the game as well as their statutory representatives, if they are minors, have the right to access and correct data concerning them. Any application for access, correction or opposition shall be addressed to BABOLAT VS.

 

Article XIII : Literary and artistic copyright

In accordance with French legislation on literary and artistic copyright, reproduction or representation of all or part of the elements making up this game is strictly prohibited. The trade marks referred to are the registered trademarks of their respective owners.

 

Article XIV: Translations

These rules have been translated into English, German, Spanish and Italian and a copy of each of these translations has been deposited with SCP FRADIN TRONEL SASSARD et Associés, huissiers de justice associés, 1, quai Jules Courmont 69002 Lyon.
